Terms of Service

Draft notice: This is a working draft prepared for review. The substantive sections are accurate, but final language should be reviewed by qualified legal counsel before this document is relied on by paying customers. A separate Service Agreement with additional terms applies to paid subscribers.

1. Acceptance

By using BeTheLocalPro ("the Service") provided by Krista Mashore Coaching ("we," "us"), you ("Customer," "you") agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

We build and host authority-positioning websites for local professionals on our multi-tenant infrastructure at bethelocalpro.com. Your site is published at a subpath such as bethelocalpro.com/[your-slug]. AI generates daily articles in your voice using inputs you supply at intake.

3. Site ownership and license

We own all right, title, and interest in the Service, including the underlying software, infrastructure, the URL slug assigned to your site, and any search engine equity and rankings that accrue to that URL. You receive a non-exclusive, non-transferable license to use and benefit from your site for the duration of your active subscription or active Krista Mashore Coaching mastermind membership.

You retain ownership of your trademarks, logos, photos, and other content you supply to us ("Customer Content"). You grant us a worldwide, royalty-free license to use, host, display, modify (for formatting and AI generation), and distribute Customer Content for the purpose of operating the Service.

4. AI-generated content and your verification duty

We use artificial intelligence systems to generate articles, page copy, FAQs, and other site content based on your inputs. AI output can contain errors, omissions, outdated information, or unintended phrasing. You are responsible for reviewing every article published under your name and for flagging or correcting any inaccuracy, misrepresentation, regulatory issue, or compliance concern. Specifically:

You must verify that statistics, dates, prices, market data, and named clients are accurate as of the publication date.
You must verify that any legal, financial, medical, or professional advice complies with applicable regulations and your licensing requirements.
You must flag any article whose voice, claims, or framing does not accurately represent you or your business.
We provide a voice-gate review of the first batch of articles before they go live. After the first batch, articles publish automatically; your ongoing review is your responsibility.
You can pause publishing at any time by emailing us.

5. Real estate, mortgage, and Fair Housing compliance (HUD)

If you are a licensed real estate agent, mortgage lender, broker, or related professional, you agree that:

All content published under your name complies with the federal Fair Housing Act (42 U.S.C. §3601-3631), the Equal Credit Opportunity Act, state and local fair housing laws, and the advertising rules of the U.S. Department of Housing and Urban Development (HUD).
You will not direct us to publish content that expresses a preference, limitation, or discrimination based on race, color, religion, sex (including gender identity and sexual orientation), handicap, familial status, national origin, or any other protected class.
You are responsible for ensuring all RESPA, TILA, and state-level advertising rules (DRE, NMLS, state mortgage authority) are met.
You are responsible for including all required licensing disclosures, brokerage affiliations, equal-housing logos, and NMLS identifiers on your site.
You will promptly notify us of any complaint, audit, or regulatory inquiry related to content on your site.

We build voice-rule guards into our system that reject obviously non-compliant Fair Housing language at publication time. These guards are a safety net, not a replacement for your own compliance review. The legal responsibility for what appears under your name and license remains with you.

6. Payment, subscriptions, and termination

Pricing is shown on our site. Setup fees are charged at signup. Monthly subscription fees recur on the same day each month via Easy Pay Direct. If a payment fails, we will attempt to reach you and retry per Easy Pay Direct's standard dunning policy. If payment remains unresolved for 14 days, we may suspend your site.

Mastermind member benefit: if your site is included as a benefit of your Krista Mashore Coaching mastermind membership, no separate monthly site fee applies while your mastermind membership is active and in good standing. If your mastermind membership ends for any reason, the benefit ends with it, and the standard monthly Authority tier fee applies if you wish to keep the site live.

You may cancel at any time by emailing doit@kristamashore.com. Cancellation is effective at the end of the current billing cycle or, for mastermind benefit recipients, immediately upon mastermind exit. Setup fees and prior monthly payments are non-refundable except as required by law.

7. Archive and resale right

If your subscription or mastermind benefit ends and you do not convert to a paid plan within 14 days, we may archive, repurpose, or resell your site (including the URL slug and any accrued search engine equity) to another professional. The new owner may inherit the slug, content infrastructure, and SEO equity. We will remove your name, photos, license numbers, and other personally identifying Customer Content before resale.

8. No site transfer or export

The Service is hosted exclusively on our infrastructure. You cannot migrate, export, or transfer your site to another hosting provider. If you require a portable site, this Service is not the right product for you.

9. Acceptable use

You agree not to:

Provide false information at intake, including impersonating another person or business
Direct us to publish defamatory, deceptive, or unlawful content
Direct us to publish content that infringes any third party's intellectual property, privacy, or publicity rights
Use the Service to violate any applicable law or regulation
Attempt to reverse-engineer, scrape, or otherwise access the underlying prompts, frameworks, or infrastructure that power the Service

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOUR SITE WILL ACHIEVE ANY PARTICULAR SEARCH RANKING, LEAD VOLUME, OR REVENUE OUTCOME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless BeTheLocalPro, Krista Mashore Coaching, and their officers, employees, and contractors from any third-party claim arising from (a) Customer Content you supplied, (b) any inaccuracy or compliance violation in content published under your name and license, including Fair Housing, RESPA, TILA, or state licensing claims, (c) your breach of these Terms, or (d) your use of the Service in violation of any law or regulation. We will notify you of any claim and let you defend it with counsel of your choice at your expense.

13. Governing law and disputes

These Terms are governed by the laws of the State of California without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Contra Costa County, California. You and we each waive the right to a jury trial.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by email to active customers at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
